Continuing from Trucking Company Negligence (Part 1)¸ the following explains some additional common examples of how trucking company negligence can cause serious traffic accidents.
- Failing to properly train truck drivers – Although commercial truck drivers should have their CDLs before being hired by trucking companies, these companies are generally responsible for training their new drivers on some of the specific duties and tasks associated with the companies’ particular fleet of vehicles. Such training can include showing drivers how to check tire pressure, properly load trucks, properly secure truckloads, etc. When trucking companies don’t properly or adequately train their drivers, and such lack of training plays a role in causing truck accidents, accident victims may have a valid personal injury claim against the negligent trucking company.
- Creating unrealistic delivery schedules for drivers – Many trucking companies try to incentivize their drivers to deliver loads ahead of schedule by offering special bonuses. In some cases, however, trucking companies may set unrealistic deadlines for their deliveries, which can force some drivers to violate federal hours-of-service regulations (which specifically set forth the maximum number of hours drivers can operate trucks each day and within a given week); federal hours-of-service regulations are in place to try to reduce the incidence of driver fatigue-related truck accidents. When trucking companies encourage their drivers to violate federal hours-of-service regulations, they can be named as defendants in truck accident lawsuits, and they may be required to compensate accident victims for their injuries and losses.
- Failing to properly maintain commercial trucks – Trucking companies are responsible for making sure that the vehicles in their fleet are well maintained and are safe to operate before allowing drivers to take them on any type of haul. Trucking companies that fail to inspect their vehicles prior to each haul and/or that fail to fix faulty or run down trucking equipment when it obviously needs to be repaired can be liable if that poorly maintained truck is involved in a traffic accident at any point in the future.
